A positive resolution has now the same legal validity as a TIE

 

This is very good news !

Have you obtained a positive resolution for your residence permit ? You are happy but you still haven’t been able to get your residency card because there are no appointments? RELAX ! Now, the resolution itself is enough to carry out any legal procedure in Spain, even if you still don’t have your TIE.

To obtain your TIE (Tarjeta de identification de extranjero) has become impossible since Covid. To find a free spot is like to win the lottery because the system is collapsed and the immigration office cannot attend to all the requests.
This is a real problem for foreigners because they need this card when they deal with the administration or when they travel.
This is why the government decided to convert any resolution issued by the Immigration Offices into a document that is comparable to the TIE for legal purposes.

Your immigration resolution (you have it on-line or on paper at home) has now the same legal validity as the TIE and will be sufficient and totally valid when interacting with the Spanish administration and any other third party.

The Ministry of the Interior, together with the Secretariat of State for Migration, have issued a statement by which from now on the foreigner will not need the TIE (the physical document containing the NIE and its type of residence) to be able to carry out any of the procedures that require it.

It’s clear that we are talking of a “favorable”  resolution issued by the immigration department…
It concerns you if you need a TIE after applying for an initial residence permit, or if you are renewing or extending the existing one, but you must know that at one point you must make the appointment for the famous “tomas de huellas” if by miracle you manage to find a slot. As far as the British citizens are concerned, the problem is not the same as they have a specific service for their TIE : the problem is with their resolution which takes a very long time.
